Thank you for choosing JOLT. We wish you many happy, safe, and enjoyable hours of responsible riding on our e-scooters and e-bikes.
A. Parties and acceptance

Who we are.
These Terms and Conditions and User Agreement (the “Terms” or “Agreement”) are between:- Strayda Holdings Limited (NZBN 9429051333942) of 7 Tunnel Grove, Gracefield, Lower Hutt 5010, New Zealand (“JOLT”, “we”, “us”, “our”); and
- you, the individual user (“you”, “User”).

What these Terms cover.
These Terms govern your access to and use of:- our website (“Site”) at www.joltscooters.co.nz;
- our mobile application (“App”); and
- our services, including rental and use of e-scooters and e-bikes and related features (“Services”),

Acceptance.
By accessing or using the JOLT Platform or Services (including creating an account, unlocking a vehicle, or taking a trip), you agree to these Terms. If you do not agree, you must not use the Services. -
Important legal notice.
Sections J (Liability & disclaimers), K (Indemnity), and M (Governing law) affect your legal rights. Please read them carefully.
B. Definitions and interpretation
- Key definitions. In these Terms:
- “Vehicle” means any e-scooter or e-bike provided by JOLT, and any attached equipment or accessories (e.g., locks, mounts, helmets if supplied).
- “Trip” means the period from when you unlock a Vehicle until you end the trip in the App.
- “Fees” means the charges for using the Services, as shown in the App or on the Site (including any applicable fees for incorrect parking, damage, recovery, or administration as permitted by these Terms and law).
- “Guidelines” means any in-app rules, no-ride/no-park zones, safety instructions, and operating rules we publish or update from time to time.
- “End-of-trip photo” means the photo you must take at the end of a Trip showing the Vehicle fully in view and correctly parked.
- Interpretation. Headings are for convenience only. “Including” means “including without limitation”.
C. Eligibility and account types (age policy)

Minimum age.
You may only use the Services if you are:- 18 years or older (a fully unrestricted account); or
- 16 or 17 years old and you have parental or legal guardian supervision and consent to use the Services, and your parent/guardian agrees to be responsible for your compliance with these Terms and associated charges (to the extent permitted by law).
- One rider per Vehicle. Only one person may ride a Vehicle at a time. No passengers.
- Account sharing prohibited. Your account is personal. You must not share login details or allow others to ride under your account.
- Accurate information. You must provide accurate, current information and keep your account details updated.
- Security. You are responsible for all activity on your account and must notify us promptly if you suspect unauthorised use.
D. Using the Services safely and lawfully

Follow the law and the Guidelines.
You must comply with all applicable New Zealand laws, road rules, and any local council or authority requirements, as well as our Guidelines (including no-ride and no-park zones shown in the App). -
Operate safely.
You must only ride if you are capable of safely operating the Vehicle. You must ride with reasonable care and consideration for others. -
Helmets and safety gear.
Where required by law, you must wear a properly fitted helmet. We recommend appropriate footwear and protective equipment at all times. -
Weather and conditions.
Do not ride in conditions that make riding unsafe (including severe weather). You are responsible for assessing conditions. -
No impairment.
You must not ride while under the influence of alcohol, drugs, medication, or any substance that may impair your ability to ride safely. -
In-App controls.
Vehicles may reduce speed in certain zones or restrict/terminate a Trip if you enter a no-ride zone or if there is extended inactivity, as indicated in the App. -
Incident reporting (important).
YOU MUST REPORT ANY INCIDENT, ACCIDENT, CRASH, PERSONAL INJURY, OR DAMAGE INVOLVING A VEHICLE TO US AS SOON AS PRACTICABLY POSSIBLE via [email protected].
E. Prohibited conduct

You must not:
- use the Services for illegal purposes or in a way that breaches any law or local requirements;
- ride with a passenger or allow any other person to ride a Vehicle rented through your account;
- ride recklessly, perform stunts/tricks, race, or use a Vehicle at skate parks or in locations/conditions likely to damage it;
- tamper with, modify, reverse engineer, dismantle, or interfere with any Vehicle hardware/software, GPS, locks, or tracking technology;
- remove, obscure, or alter labels, identifiers, or safety notices on a Vehicle;
- tow or be towed by a Vehicle, attach a Vehicle to another device, or carry loads that interfere with safe operation;
- ride while using a mobile device in a way that distracts from safe operation (other than to operate the Trip in the App when stationary);
- harass, stalk, threaten, or impersonate any person;
- use scraping, bots, or automated tools to access or extract data from the Platform;
- upload or transmit malware, viruses, or harmful code; or
- do anything that is inconsistent with the purpose of the Services or that undermines safety, compliance, or enforcement.
F. Vehicle condition, end-of-trip requirements, and your responsibility

Vehicles remain our property.
Vehicles are owned by JOLT at all times. You receive a limited right to use a Vehicle during a Trip. -
Pre-ride inspection.
Before riding, you must inspect the Vehicle (including brakes, tyres, throttle, steering, and lights where fitted). Do not ride if the Vehicle appears unsafe. Report issues promptly to [email protected]. -
End-of-trip photo and securing the Vehicle.
At the end of your Trip, you must:- park in a safe, lawful location, preferably a designated parking location shown in the App;
- ensure the Vehicle is upright and not blocking access (e.g., footpaths, ramps, driveways);
- secure the Vehicle as instructed in the App; and
- take an End-of-trip photo with the Vehicle fully in view.

Responsibility during custody.
You are responsible for the Vehicle from activation/unlock until the Trip is properly ended and the Vehicle is secured, including any applicable Fees and any damage occurring during that time (fair wear and tear excepted). -
Malfunction, damage, or theft.
You must notify JOLT immediately if a Vehicle malfunctions, is damaged, lost, or stolen: [email protected].
G. Incorrect parking, damage, lost/stolen Vehicles, and enforcement

Incorrect parking fee.
If you end a Trip in an unsafe or unlawful manner (including blocking a footpath, leaving a Vehicle tipped over, or leaving it in/near waterways), we may charge an incorrect parking fee of up to NZ$50, where permitted by law. -
Repair/replacement and recovery costs.
If a Vehicle is damaged (fair wear and tear excepted), lost, stolen, or detained while in your custody or as a result of your Trip, we may charge your payment method on file for:- reasonable repair costs, or replacement cost if repair is not commercially viable;
- reasonable recovery costs (e.g., towing/retrieval); and
- any outstanding usage charges and other reasonable costs actually incurred in connection with the incident, to the extent permitted by law.

End-of-trip photo as evidence.
You acknowledge the importance of the End-of-trip photo as evidence of correct parking and Vehicle condition. In the absence of an End-of-trip photo (and absent evidence to the contrary), it may be reasonable for us to determine that the Vehicle was left incorrectly parked or in a damaged condition during your Trip. -
Suspension/termination.
We may suspend or terminate your account for misuse, safety breaches, fraud, repeated incorrect parking, or damage incidents.
H. Fees, payment, debt recovery, and billing disputes

Fees and GST.
Fees are shown in the App and/or on the Site. Unless stated otherwise, prices are inclusive of GST. -
Payment method and authorisations.
You must maintain a valid payment method. You authorise us to charge applicable Fees, including usage charges and any amounts you owe under these Terms. We may also seek pre-authorisation where reasonably necessary for operation of the Services. -
Billing disputes.
If you believe there is a billing error, you should notify us as soon as possible (and preferably within 30 days) at [email protected] so we can investigate. This does not limit your rights under New Zealand law. -
Debt recovery.
If payments are overdue, we may use a debt collection agency. You may be responsible for reasonable costs actually incurred in recovering overdue amounts, to the extent permitted by law. -
Administration fees (if referred).
Where permitted by law, we may charge a reasonable administration fee associated with late payment handling or referral to collections (for example, up to NZ$50), where it reasonably reflects our costs.
I. Refunds

Pay-per-ride.
Generally, pay-per-ride charges are not refundable because the Service is consumed as you ride. -
When refunds may be provided.
Refunds (or credits) may be provided where:- we have made a billing error;
- you are entitled to a remedy under applicable consumer protection laws (including the Consumer Guarantees Act 1993);
- we suspend or cease providing the Services and you have unused pre-purchased value (if applicable), except where this is due to events beyond our reasonable control; or
- we determine (acting reasonably) that a refund/credit is appropriate in the circumstances.

You can request a refund review by emailing [email protected]. We may ask for details (time/location/Trip) to assess the request.
J. Liability, disclaimers, and assumption of risk

Riding involves risk.
You acknowledge that riding e-scooters/e-bikes involves risks (including serious injury, death, and property damage). You are responsible for riding safely and lawfully. -
ACC and personal injury.
New Zealand’s accident compensation scheme (ACC) may apply to personal injuries. Nothing in these Terms is intended to limit any rights you may have under the Accident Compensation Act 2001 or other non-excludable rights under New Zealand law. -
Services provided “as is”.
To the maximum extent permitted by law, the App, Site, Services, and Vehicles are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability or that the Services will be error-free. -
Limitation of liability (subject to law).
To the maximum extent permitted by law:- we are not liable for indirect or consequential loss; and
- our total aggregate liability for claims arising out of or relating to the Services is limited (at our option) to either:
- re-supplying the relevant Service; or
- the total Fees you paid to us for the Services in the 12 months before the event giving rise to the claim.

Non-excludable rights.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under New Zealand law that cannot be excluded, including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
K. Indemnity

You indemnify us for your wrongdoing.
To the maximum extent permitted by law, you agree to indemnify JOLT and its officers, employees, and contractors against losses, damages, fines, and claims arising from:- your illegal, negligent, reckless, or wilful acts or omissions in connection with the Services;
- your breach of these Terms or applicable laws; or
- damage to property or injury to others caused by your use of a Vehicle.
L. Privacy and communications

Privacy policy.
Our Privacy Policy explains how we collect and use personal information (including location and Trip data). The Privacy Policy forms part of these Terms by reference. -
Location and Trip data.
We may collect and use location data when the App is operating to provide the Services and operate Vehicles, subject to the Privacy Policy and applicable law. -
Privacy Act 2020 and breach notices.
Where we are required by the Privacy Act 2020 (including the notifiable privacy breach regime), we may notify you using the email address or phone number associated with your account. -
Messages.
By creating an account, you consent to receiving service-related communications (e.g., receipts, Trip status, safety messages). You may opt out of non-essential marketing communications where available, but you may still receive essential operational messages.
M. Termination
- Termination by you. You may close your account by giving at least 7 days’ notice in writing to [email protected], or via any in-app method we provide.
- Termination by us. We may suspend or terminate your account immediately if you breach these Terms, misuse the Services, create safety risks, or engage in fraud or unlawful conduct.
- Effect of termination. Termination does not affect any accrued rights or outstanding amounts owed.

O. Consumer rights

Your consumer rights are protected.
These Terms are in addition to (and do not exclude, restrict, or modify) your rights and remedies under applicable New Zealand consumer protection legislation, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
P. General
- Changes to these Terms. We may update these Terms from time to time by posting an updated version on our Site and/or in the App. Continued use of the Services after changes take effect means you accept the updated Terms.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in effect.
- Assignment. You may not assign your rights under these Terms without our written consent. We may assign these Terms as part of a business transfer or restructure.
- Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control.
- Governing law. These Terms and any dispute are governed by the laws of New Zealand, and the parties submit to the courts of New Zealand.
